To implement the Official Letter No. 469/CD-TTg of the Prime Minister on removing and promoting the real estate market to develop safely, healthily and sustainably

On 22/6/2023, the Provincial People's Committee issued the Official Letter No. 1604/UBND-KT2 on the implementation of the Official Letter No. 469/CD-TTg of the Prime Minister.

Accordingly, the Provincial People's Committee directs as follows:

- The Department of Construction:

+ To focus on implementing, guiding, urging, reviewing, elaborating, appraising and approving master plans, for plannings that have passed the deadline, to implement according to the Resolution No. 61/2022/QH15 dated June 16, 2022 of the National Assembly, completed according to the time limit specified in the above resolution.

+ To guide localities and organizations related to real estate projects that have been approved by competent authorities for investment policies, the detailed planning has been approved by the province but not updated or added to the subdivision planning, general planning, and provincial planning, the planning shall be reviewed and adjusted according to its competence and in accordance with the provisions of law to ensure the consistency and synchronization of the planning levels, not legitimize wrongdoings that lead to corruption and negativity.

+ To focus on implementing, guiding and urging relevant localities and organizations to review and submit to competent authorities for approval (approval and adjustment) of the general planning, zoning planning, detailed construction planning for implementation of commercial housing, social housing and real estate projects in the province; continue to focus on advising to effectively implement the project "Investment in building at least 01 million social housing apartments for low-income people and industrial park’s workers in the 2021-2030 period".

+ To advise the Provincial People's Committee to announce and publicize on the Portal the list of projects at the request of the investor and send a document to the State Bank of Vietnam on the list of communal housing projects, housing for workers, the projects to renovate and rebuild old apartments so that commercial banks have a basis to apply for loans under the credit program of VND 120,000 billion.

+ To review and summarize commercial housing projects that have not yet been allocated land fund for social housing development in accordance with the law, and report to the Provincial People's Committee.

+ To assume the prime responsibility for, and coordinate with relevant sectors, localities and agencies in promoting monitoring and supervision of the local real estate market situation in order to promptly take appropriate measures and solutions to stabilize the situation, keep the market safe, healthy and sustainable.

+ To coordinate with the Department of Planning and Investment in reviewing and classifying real estate projects facing difficulties and problems to advise the Special Working Group to remove difficulties and obstacles, and support businesses, investors, investment projects in the province according to the Decision No. 905a/QD-UBND dated April 20, 2023 of the Provincial People's Committee.

- The Department of Natural Resources and Environment:

+ To advise the Provincial People's Committee to issue specific regulations according to its competence to implement the provisions of the law on land, such as: Specific regulations on the conditions for separation of land plots, the conditions for land parcel consolidation for each type of land and minimum area to be divided for each type of land...

+ To mobilize organizations and experts to appraise land according to their competence, in accordance with the law and take responsibility before the Chairman of the Provincial People's Committee if there is a delay, affecting the implementation progress of the investment projects. In case of any problems, send documents to the Ministry of Natural Resources and Environment for guidance and timely settlement.

+ To focus on building and expeditiously approving master plans and plannings on land use to ensure the land fund for the development of social housing and worker housing.

+ To focus on well conducting the work of compensation, support and resettlement, speed up the reform of administrative procedures to carry out the allocation and lease of land to investors, ensuring that the land is put into use soon, promote land resources for socio-economic development. The determination of land prices for calculation and collection of land use levies and land rents shall comply with the provisions of Articles 108, 112, 114 of the Land Law and guiding documents, in compliance with the provisions of law, not cause loss to the state budget.

- Departments and branches; the People's Committees of districts, town and city:

+ To seriously and effectively perform the tasks and solutions assigned by the Government and the Prime Minister in the Resolution No. 33/NQ-CP dated March 11, 2023, the Official Letter No. 1164/CD- TTg dated December 14, 2022, the Official Letter No. 178/TTg-CN dated March 27, 2023, the Official Letter No. 194/CD-TTg dated April 1, 2023, the Notice No. 133/TB-VPCP dated April 16 2023 and at the decisions and directions of the previous Prime Minister, the guiding documents of the Provincial People's Committee. Sectors and localities consider this an urgent and important task to focus on solving according to the principle that problems falling under the authority of any level must be resolved by that level. Sectors focus on guiding localities on the regulations in their fields to solve current problems, not dodge a question.

+ To urgently grasp to each unit, cadre, civil servant and public employee the strict implementation of the Prime Minister's direction at the Official Letter No. 280/CD-TTg dated April 19, 2023 and the direction of the Provincial People's Committee in the Official Letter No. 1247/UBND-NC dated May 19, 2023; resolutely overcome the situation of avoiding and pushing work, fear of being wrong, afraid of responsibility, not daring to advise and propose to handle work, shorten processing time and improve effectiveness and efficiency in leadership and management. To strictly handle organizations and individuals that avoid or push work, abdicate tasks, or lack responsibility to delay or fail to decide on the issues or tasks under their authority; carry out rotation and handling of cadres who are afraid of mistakes and fear of responsibility in performing official duties. To timely praise and reward collectives and individuals that well perform their assigned responsibilities and tasks, protect cadres who dare to think and do for the common good.

+ The Chairmen of the People's Committees of districts, town and city: To actively and proactively perform their duties and powers as prescribed by law, take responsibility for deciding issues within their competence or as assigned and authorized according to the provisions of law; falling to submit or report on the work within their competence to the superior; not abuse the consultation of other agencies to avoid responsibility. To urgently review the tasks and works of the locality to promptly consider and decide according to their competence and within the time limit prescribed by law, especially for jobs that have been delayed or prolonged.
