To amend the regulations on agencies registering for water entertainment facilities

On 23/2/2024, the Government has just issued Decree No. 19/2024/ND-CP amending and supplementing a number of articles of Decree No. 48/2019/ND-CP dated June 5, 2019 of the Government regulating on the management of operations of water entertainment facilities.

Accordingly, the Decree amends and supplements Clause 1, Article 9 as follows: The Department of Transport approves water entertainment activities in zone 1.

The Decree also amends and supplements Article 11 of the authority to negotiate and announce the opening and closing of active zone in zone 2.

Specifically, the People's Committees of the district, town, province's city, city under the centrally-run city (the district-level People's Committee) (in former regulations: the Provincial-level People's Committee) implement the agreement and announce the opening and closing of the active zone in zone 2.

Before implementing a construction investment project, the investor contacts the district-level People's Committee to make an agreement on the location, scale, and measures to ensure security, safety, rescue, and prevent environmental pollution. The project investment is carried out in accordance with the provisions of law on investment and construction.

The Decree amends and supplements Article 19 of the facility registration agency. Specifically, the district-level People's Committee (in former regulations: the provincial-level People's Committee) organizes the implementation and management of the registration and management of water entertainment facilities that must be registered according to the provisions of this Decree and other relevant provisions of law.

The commune-level People's Committees that manage water entertainment facilities are exempt from registration.

The Decree amends and supplements Article 28 of the responsibilities of the People's Committees of provinces and centrally-run cities. Specifically, organize the implementation of state management functions regarding the management of activities of water entertainment facilities according to the provisions of this Decree and other relevant provisions of law.

To direct the district-level People's Committee to organize and implement as follows: Manage the registration of water entertainment facilities; inspect and supervise the the commune-level People's Committee in organizing and managing facilities exempt from registration within the scope of management according to the provisions of this Decree and other relevant provisions of law; organize and manage water entertainment activities in zone 2 under its management.

To direct the Department of Transport to organize and manage water entertainment activities in zone 1 within the scope of management according to the provisions of this Decree and other relevant provisions of law.

This Decree takes effect from April 10, 2024.
