27/02/2024 | lượt xem: 6 in: To amend regulations on issuance of airport and aerodrome registration certificates On 23/2/2024, the Government has just issued Decree No. 20/2024/ND-CP amending and supplementing a number of articles of Decree No. 05/2021/ND-CP dated January 25, 2021 on the management and exploitaion of airport and aerodrome operations and Decree No. 64/2022/ND-CP dated September 15, 2022 amending and supplementing a number of articles of Decrees related to business activities in the civil aviation sector. The Decree No. 20/2024/ND-CP amended and supplemented Article 52 of Decree No. 05/2021/ND-CP regulating the issuance of airport and aerodrome registration certificates. Specifically: 1. The owner or organization assigned to manage an airport or aerodrome shall send 01 set of application document for an airport or aerodrome registration certificate directly or via the postal system or in the electronic environment or in other suitable forms to the Airport Authority. Records include as follows: - The application for issuance of airport and aerodrome registration certificate, according to Form No. 01 specified in the Appendix issued with this Decree; - The copy or electronic copy of the decision to establish a business of the owner or the organization assigned to manage the airport or aerodrome (in case there is no business registration certificate); - The copy or electronic copy of the decision on investment policies or decision on investment in airport and aerodrome in case of new construction, renovation, upgrading or expansion of airport and aerodrome; - The copy or electronic copy of documents certifying that the airport’s and aerodrome’s infrastructure has been completed acceptance procedures according to regulations on construction investment in case of new construction, renovation or upgrading, expanding airports and aerodromes. 2. In case an airport or aerodrome is under construction, the owner or the organization assigned to manage the airport or aerodrome shall submit 01 application for a temporary registration certificate of airport and aerodrome directly or through the postal system or electronic environment or in other appropriate forms to the Airport Authority. The dossier includes documents specified in Points a, b, c, Clause 1 of this Article. 3. Within 10 days from the date of receiving valid documents according to regulations, the Airport Authority is responsible for appraising the documents, including the following contents: The airport and aerodrome are built in accordance with the approved master plan for development of the national airport and aerodrome system; the infrastructure of airports and aerodromes is built and technically accepted in accordance with prescribed standards and technical regulation and operational capacity; the Plans to build airport and aerodrome infrastructure in accordance with technical standards as prescribed for temporary registration of airports and aerodromes under construction and operating capacity. 4. Within 03 working days from the date of appraisal, the Airport Authority shall issue a certificate of airport and aerodrome registration according to Form No. 02 in the Appendix issued with this Decree and send the results directly or through the postal system or the electronic environment or in other appropriate forms to the owner or organization assigned to manage the airport or aerodrome; send the Civil Aviation Authority of Vietnam the results of granting the airport and aerodrome registration certificate to register the airport and aerodrome in the Airport and Aerodrome Register. In case of refusal to issue an airport or aerodrome registration certificate, the Airport Authority shall notify in writing, clearly stating the reason. 5. No later than 60 days after completion of construction, airports and aerodromes that have been granted temporary registration certificates must be registered according to the provisions of this Decree. 6. The lost or damaged airport or aerodrome registration certificates are requested to be reissued. The person granted the airport and aerodrome registration certificate shall submit an application for re-issuance of the certificate directly or through the postal system or electronic environment or in other appropriate forms according to Form No. 01 at Appendix issued together with this Decree to Airport Authority. Within 03 working days from the date of receipt of the application according to regulations, the Airport Authority shall consider and decide to re-issue the airport and aerodrome registration certificate and send the results directly or through the postal system or in the electronic environment or by other suitable forms to the requester. In case of refusal to re-issue, the Airport Authority shall notify in writing the reason for refusal. 7. The airport or aerodrome registration certificate is revoked in case it no longer meets the conditions to be granted an airport or aerodrome registration certificate. The Decree No. 20/2024/ND-CP also amends and supplements Article 60 on issuance of certificates of technical eligibility for specialized aviation equipment and vehicles manufactured, assembled and improved in Vietnam . The Decree No. 20/2024/ND-CP abolishes a number of articles of Decree No. 64/2022/ND-CP dated September 15, 2022 of the Government amending and supplementing a number of articles of related Decrees to business activities in the field of civil aviation. Specifically: Abolish point c, clause 5; clause 6; point a clause 7; point a, point b clause 10; clause 13; abolish the phrases "Clause 1, Article 52" and "Clause 1, Article 60" in Clause 12, Article 3. This Decree takes effect from April 10, 2024.
