The Official letter of the Ministry of Industry and Trade on the management and development of industrial clusters

On 22/3/2024, the Ministry of Industry and Trade issued the Official letter No. 1817/BCT-CTDP on the management and development of industrial clusters.

Accordingly, in order to deploy, fully and strictly comply with the provisions of law, improve the efficiency of investment in industrial clusters development, the Ministry of Industry and Trade requests the People's Committees of provinces and centrally-run cities such the following content as:

- While the Decree No. 32/2024/ND-CP dated March 15, 2024 of the Government has not yet taken effect, it is recommended to continue to strictly carry out the management and development of industrial clusters according to the provisions of Decree No. 68/2017/ND-CP dated May 25, 2017 and Decree No. 66/2020/ND-CP dated June 11, 2020 of the Government and related laws.

- Based on the powers and responsibilities in Decree No. 32/2024/ND-CP, the People's Committees of provinces and centrally-run cities proactively organize the implementation of the provisions of the Decree.

- Regarding the industrial cluster development plan under the Provincial Planning for the period 2021-2030, with a vision to 2050 in the area:

+ For localities whose Provincial Planning has not been approved, it is recommended to coordinate with relevant agencies to urgently complete and submit to the Prime Minister for approval.

+ For localities with the approved Provincial Planning, during the process of planning and organizing the implementation of the industrial cluster development plan in the area, it is recommended to:

i) Review the industrial complex development plan during the planning period to ensure complete information for each industrial complex (including: name, location, area, business lines, technical infrastructure investment progress) according to the provisions of Decree No. 66/2017/ND-CP; ensuring feasibility, synchronization, consistency and no overlap with other plans in the area. In case the industrial complex development plan under the approved Provincial Planning does not have enough information as prescribed or overlaps with other plans in the area, the Provincial People's Committee shall direct the handling or report to the competent authority according to regulations.

ii) Develop a specific plan to implement the industrial complex development plan for the period 2021-2030 to ensure feasibility; sufficient land fund to establish and invest in industrial cluster development in the list according to the approved planning schedule.

iii) For industrial clusters withdrawn from the planning: Make management solutions and feasible conversion plans, in accordance with relevant legal regulations; in particular, pay attention to strict management of the environment, security and order, fire and explosion prevention, ensure the legitimate rights and interests of relevant businesses, organizations and individuals.

- To direct investment promotion, attraction and selection of businesses with sufficient capacity and experience as investors in industrial cluster technical infrastructure. To orient and prioritize the promotion of businesses/secondary investment projects with the same industry and ability to link and support each other into the same industrial cluster; industrial sectors according to the Provincial Planning orientation have high technology, are clean, consume little energy, bring high added value, and develop sustainably in the industrial complex.

- To regularly review the progress of investment in building technical infrastructure (noting that industrial clusters must have environmental protection infrastructure according to regulations), attract investment in industrial clusters in the area to have solutions to solve difficulties, speed up investment progress, promote efficiency; completely handle industrial clusters and projects in industrial clusters that cause environmental pollution, ineffective land use, improper purposes, and slow progress.

- To strengthen inspection, examination, and handling of legal violations at industrial cluster in the area (such as: Laws on land, investment, construction, environmental protection, fire prevention and fighting and other relevant laws) to rectify the management, investment and development of industrial clusters in the area in accordance with the provisions of law.
