The Circular stipulates the sample dossier for selecting investors to implement projects in case bidding must be organized according to the provisions of law on industry and field management.

On 06/3/2024, the Ministry of Planning and Investment issued Circular No. 03/2024/TT-BKHDT stipulating the sample dossier for selecting investors to implement projects in case bidding must be organized according to the provisions of laws on industry and field management.

* Accordingly, the Circular stipulates the sample dossier for selecting investors to implement projects in case bidding must be organized according to the provisions of law on industry and field management, including:

1. Sample Notice of Invitation for Expression of Interest, Application for Invitation for Expression of Interest.

2. Sample of one-stage, one-envelope bidding documents.

3. Sample of one-stage, two-envelope bidding documents.

* Regarding preparation of invitation for expression of interest documents, bidding documents and principles of sample application:

- The interested party, the bidding party, and the expert group organize the preparation of invitation for expression of interest notice, invitation for expression of interest documents, and bidding documents as follows:

+ Notice of invitation for interest and documents of invitation for interest are prepared according to the form specified in Appendix I issued with this Circular;

+ Bidding documents are prepared according to the form specified in Appendix II issued with this Circular for projects applying open bidding or limited bidding according to the one-stage, one-envelope method;

+ Bidding documents are prepared according to the form specified in Appendix III issued with this Circular for projects applying open bidding according to the one-stage, two-envelope method.

- In Appendices I, II and III issued with this Circular, the italicized content is for guidance and illustration purposes and specified on the basis of scale, nature, field and specific conditions (if any) of each project.

- For projects applying open bidding according to the two-stage, one-envelope method, the bid solicitor shall apply Appendix II issued with this Circular, ensuring compliance with the provisions of the Bidding Law No. 22/2023/QH15 and Decree No. 23/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Bidding Law on selecting investors to implement projects falling into the case of having to organize bidding according to the provisions of law on industry and field management.

The Circular takes effect from March 6, 2024.
