The Circular guiding the provision and posting of information on contractor selection and bidding document templates on the National Bidding Network System

On 15/02/2024, the Ministry of Planning and Investment issued Circular No. 01/2024/TT-BKHDT guiding the provision and posting of information on contractor selection and bidding document templates on the National Bidding Network System.

Accordingly, this Circular guides the provision and posting of information on contractor selection and bidding document templates, including: Forms for preparation, appraisal, and approval of the overall contractor selection plan, contractor selection plan for projects and procurement estimates according to the provisions of Article 1 and Article 2 of the Bidding Law; the bidding document templates on the national bidding network system for bidding packages providing consulting services, non-consulting services, goods, construction and installation, and drugs purchasing within the scope of the Bidding Law are organized in open bidding, limited bidding, domestic competitive bidding according to the method of one stage, one envelope of documents, one stage, two envelopes of documents.

The national bidding network system (hereinafter referred to as the System) is an information technology system built and managed by the Ministry of Planning and Investment according to the provisions of Clause 18, Article 4 of the Bidding Law, with the address at https://muasamcong.mpi.gov.vn. "National information system on business registration" is a professional information system on business registration specified in Clause 2, Article 3 of Decree No. 01/2021/ND-CP dated January 4 2021 of the Government on business registration.

* Regarding the regulations on the format of attached files

+ Files posted on the System must ensure:

- Files can be opened and read with common software such as MS Office or Open Office reading and editing software; PDF file reading software; popular design software such as AutoCad, Photoshop; built-in image file reading software on Windows Operating System. Files use Unicode fonts;

- Compressed files can be opened with popular decompression software such as the built-in ZIP decompression software on Windows operating systems or Rar or 7Zip decompression software. In case of using compressed files, the files after decompression must have the format specified in Point a of this Clause;

- No virus infection, no error, no corruption and no password set.

+ In case the attached file in the request for expression of interest document, E-HSMQT, pre-qualification document, E-HSMST, bidding document, E-HSMT does not meet the provisions in Clause 1 of this Article or for other reasons resulting in being unable to open or read, the soliciting party must post and reissue the entire invitation for expression of interest documents, E-HSMQT, pre-qualification documents, E-HSMST, bidding documents, E-HSMT .

+ In case the attached files in the E-HSDT, E-HSQT, E-HSDST do not meet the requirements specified in Clause 1 of this Article and cannot be opened or read, these files will not be considered and evaluated.

* Regarding technical handling in case the System encounters problems beyond control

- In case of problems leading to the System not being able to operate, online contractor selection bidding packages have a bid closing time and an expiration time to clarify the E-HSQT, E-HSDST, and E-HSDT within the time limit. From the time the System crashes until the time after 02 hours of completing the troubleshooting, it will be automatically extended by the System until the time of closing a new bid, the new time of expiry of clarifying E-HSQT, E-HSDST is 6 hours after completing the troubleshooting.

- In case the time for closing a new bid and the new expiration time for clarifying E-HSQT, E-HSDST as prescribed in Clause 1 of this Article is after 5:00 p.m. and before 11:00 a.m. the following day, then the System automatically renews until 11:00 a.m. the next day.

- In case the System automatically extends the bid closing time according to the provisions of Clause 1 and Clause 2 of this Article, the evaluation of E-HSQT, E-HSDST will be carried out on the basis of the stated bid closing time in E-TBMQT, E-TBMST, E-TBMT before the System crashed.

- In case of a problem leading to the National Bidding Network System not being able to operate and troubleshooting is expected to take place over a long period of time, the Ministry of Planning and Investment shall notify on the National Bidding Network System on how to organize contractor selection during times when the National Bidding Network System has problems and handles problems, including organizing non-online contractor selection.

* About account management and use of digital certificates

- To create professional accounts: Accounts participating in the System create and delegate rights to professional accounts corresponding to the roles of organizations participating in the System specified in points a, b, c, d and đ Clause 8, Article 3 of this Circular; lock, unlock; reset password, authentication form, login authentication device for professional account.

- To use digital certificates on the System: Organizations that are issued digital certificates when participating in the System must register to use digital certificates according to the Instructions for Use. The digital certificate used on the System is the digital certificate issued to the organization; digital certificates are used to create digital signatures and authenticate organizations; the registration of using, changing, and canceling digital certificate information of organizations participating in the System is done on the System according to the User Instructions; organizations participating in the System are responsible for ensuring the accuracy of digital certificates used on the System.

In addition, the Circular also provides specific instructions on providing and posting information on contractor selection; the contents of bidding document templates and implementation organization.

This Circular takes effect from February 15, 2024. From January 1, 2024, the Circular No. 08/2022/TT-BKHDT dated May 31, 2022, the Circular No. 10/2015/TT-BKHDT dated October 26, 2015 of the Ministry of Planning and Investment will expire.
