Three countries added to apply preferential import and export taxes under the CPTPP Agreement

On 7/9/2023, the Government issued the Decree No. 68/2023/ND-CP amending and supplementing a number of articles of the Decree No. 115/2022/ND-CP dated December 30, 2022 of the Government promulgating Vietnam's Special Preferential Export Tariff and Preferential Import Tariff to implement the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP Agreement) for the period of 2022-2027.

Specifically, the Decree No. 68/2023/ND-CP adds Malaysia, Chile and Brunei to apply Vietnam's special preferential export tariff and preferential import tariff to implement the CPTPP Agreement for the period of 2022- 2027.

The Decree No. 68/2023/ND-CP clearly states, for customs declarations of goods exported from Vietnam to Malaysia or imported into Vietnam from Malaysia registered from November 29, 2022 to before September 7, 2023; for customs declarations of goods exported from Vietnam to the Republic of Chile or imported into Vietnam from the Republic of Chile registered from February 21, 2023 to before September 7, 2023; for customs declarations of goods exported from Vietnam to Brunei or imported into Vietnam from Brunei registered from July 12, 2023 to before September 7, 2023, if all conditions are met to enjoy special preferential export tariff and preferential import tariff prescribed in the Decree No. 115/2022/ND-CP dated December 30, 2022 of the Government, the Decree No. 68/2023/ND-CP and have paid tax at the higher tax rate, the Customs authority will handle the overpaid tax according to the provisions of law on tax management.

The Decree No. 68/2023/ND-CP takes effect from the date of signing.
