The Provincial People's Council passed a Resolution stipulating criteria for deciding to conduct bidding to select investors to implement investment projects using land in Hung Yen province
On 11/12/2024, at the 23rd Session, the 17th Provincial People's Council passed the Resolution No. 520/2024/NQ-HDND stipulating criteria for deciding to conduct bidding to select investors to implement investment projects using land in Hung Yen province.
Accordingly, the scope of the Resolution is to stipulate criteria for deciding to conduct bidding to select investors to implement investment projects to build urban areas with mixed-use functions, synchronizing technical infrastructure systems, social infrastructure with housing according to the provisions of the law on construction for new construction or urban renovation and embellishment; rural residential area projects are decided by the Provincial People's Council on land allocation and lease through bidding to select investors to implement investment projects using land in Hung Yen province.
The applicable subjects include agencies, units, organizations and individuals related to the decision to conduct bidding to select investors to implement investment projects using land as prescribed in Article 1 of this Resolution.
According to the Resolution, the investment projects using land as prescribed in Clause 1, Article 1 of this Resolution shall conduct bidding to select investors when meeting the following criteria:
- The criteria on land for project implementation: The project is subject to land recovery as prescribed in Clause 27, Article 79 of the Land Law No. 31/2024/QH15. In case the land area for project implementation includes the land specified in Clause 1, Article 217 of the Land Law, the State shall reclaim it to allocate or lease the land through bidding to select an investor to implement the project for the entire land area.
The land area for project implementation is not subject to the auction of land use rights as prescribed in Clause 2, Article 125 of the Land Law.
- The criteria for conformity with planning: The project is consistent with the development orientation in the Hung Yen Provincial Master Plan for the period 2021-2030, with a vision to 2050; construction planning at all levels;
The project has a detailed plan or a 1/2,000 scale zoning plan approved by a competent authority;
The project is consistent with the Housing Development Program and Plan; the Urban Development Program approved by a competent authority;
The project is consistent with the district-level land use plan approved by a competent authority.
- The criteria on project scale and area: For new urban area construction investment projects: projects are invested in building new, synchronous technical infrastructure system and social infrastructure, forming from one residential unit or more according to the approved zoning plan or projects with a land use scale of 20 hectares or more in cases the zoning plan does not clearly define residential units.
For urban renovation and embellishment projects: housing construction investment projects implemented in existing urban areas, with the goal of investing in construction, renovation, and synchronous technical infrastructure and social infrastructure to meet housing needs.
For rural residential area projects: housing construction investment projects in rural areas, with new construction investment, synchronous construction of technical infrastructure and social infrastructure systems.
The Resolution takes effect from December 21, 2024.
