The license to establish a representative office of a foreign trade promotion organization reissued

On 07/02/2024, the Government has just issued Decree No. 14/2024/ND-CP amending and supplementing a number of articles of Decree No. 28/2018/ND-CP dated March 1, 2018 of the Government detailing the Law on Foreign Trade Management on a number of measures to develop foreign trade.

According to Decree No. 14/2024/ND-CP, the License to establish a Representative Office of a foreign trade promotion organization is reissued in the following cases:

- The representative office establishment license is lost, burned, torn, crushed or destroyed in another form;

- To change the location of the Representative Office's headquarters to another province or centrally-run city. At least 90 days before the expected date of change of headquarters location, the foreign trade promotion organization or Representative Office must send a notice of change of headquarters location to creditors and employees in the Representative Office, people with rights, obligations and other related interests. This notice must clearly state the expected time of changing the location of the Representative Office's headquarters, must be publicly posted at the Representative Office's headquarters and published in a written or electronic newspaper licensed to be distributed in Vietnam in 3 consecutive issues.

Foreign trade promotion organizations may choose one of the following ways to submit an application for extension of the License to establish a Representative Office of a foreign trade promotion organization:

- To send via postal service to the licensing agency;

- To submit directly at the headquarters of the licensing agency. The applicant must have a letter of introduction or authorization from the Representative Office of a foreign trade promotion organization;

- To submit legally valid electronic application components online via the National Public Service Portal or the Provincial-level Administrative Procedures Information System.

This Decree takes effect from March 25, 2024.
