To improve the quality and efficiency of investment projects to build technical infrastructure for new residential areas invested by the People's Committees of districts and communes

On 04/5/2022, the Provincial People's Committee issued the Official Letter No. 1113/UBND-KT1 on improving the quality and efficiency of investment projects to build technical infrastructure for new residential areas invested by the People's Committees of districts and communes.

Accordingly, the Provincial People's Committee has directed a number of contents as follows:

- Regarding the planning, determining the location and scale of residential projects

+ The People's Committees of districts shall urgently direct the People's Committees of communes to review and adjust the general planning of townships, the general planning on the construction of communes (on the basis of the new rural areas construction planning) to make the basis for determining the location and scale of residential projects, investing in infrastructure projects meeting the criteria of building an enhanced newly rural area and a model newly rural area. To elaborate the regulations on management of urban architecture, the regulations on management of architecture of rural residential quarters as a basis for the management of investment in housing construction in residential areas. Time to review planning and set up regulations on architectural management is in 2022.

+ Determining the location of the residential area: The location of the residential project must be consistent with the construction planning, master plan, and land use plan; study and select the area adjacent to the existing residential area to combine the expansion, renovation and embellishment of the old residential area, connect and synchronously invest in infrastructure for the whole area; limit the selection of locations adjacent to provincial roads and national highways. The dossier submitted to the Provincial People's Committee for the approval of new residential area's location should include the following contents: The preliminary ground planning plan; preliminary financial plan (the estimate of total investment in infrastructure construction, the cost of site clearance, the expected revenue from land auction and the use of this revenue).

+ The detailed planning (or total ground) of residential areas: The detailed planning (or total ground) of residential areas must be consistent with current regulations and standards on construction planning, ensure the efficient use of land. For residential areas in urban communes of class V or in urban development-oriented areas, the planning shall be made according to urban criteria. For residential areas adjacent to provincial roads and national highways, a system of roads gathering residential areas must be planned to connect provincial roads and national highways through side roads and intersections; not plan a row of houses to stick directly to provincial roads and national highways. The planning content (total ground) must show in detail and fully the structure of land use; the area, the land use norms of each land plot; clearly show the red line; constructional boundaries. For each land plot for housing construction, it is required to clearly show the norms of construction density, works setback, land use coefficient, number of floors, height of works, elevation of construction foundation, elevation of floors; preliminary architectural design plan (vertical facade, longitudinal section, perspective...) with the goal of not letting houses built in a mess, but synchronous in landscape architecture, create beauty for districts, town and city in particular and the province in general).

- Regarding the management of infrastructure construction and investment projects; land auction organization and the housing construction and investment:

+ To manage the implementation of infrastructure construction and investment projects: formulate, appraise, approve and invest in infrastructure construction of residential projects, ensure the provisions of the law on public investment, the Law Construction and related law documents. The area where the land use rights auction is held for housing must be fully invested with technical infrastructure before the land use right auctions is held.

+ The auction of land use rights for housing: The organization of auction of land use rights for people to build houses shall comply with the provisions of the law on land and the Law on asset auction after the infrastructure investment has been completed. The content of the auction dossier, in addition to the provisions of the Law on Property Auction, needs supplementing to clearly show the criteria of each auctioned land lot (according to the detailed planning or the approved total ground); the conditions and requirements on construction time, complying with construction planning, as a basis for the control and management of housing construction after winning the auction.

- The management of investment in housing construction: The People's Committees of districts and communes are responsible for supervising and managing the housing construction by people when winning the auction to ensure compliance with the detailed planning (total premises), the architectural management regulations, the auction organization plan; granting the construction permits and managing construction according to the granted permits for housing works subject to construction permits.
