The Directive to the Prime Minister on promoting land use planning and plans at all levels

On 11/8/2021, the Prime Minister issued the Directive No. 22/CT-TTg on promoting land use planning and plans at all levels.

According to the Directive, implementing the provisions of the law on planning, the law on land, in the past time, ministries, ministerial-level agencies and the People's Committees of provinces and centrally-run cities are concurrently making plannings under the national planning system for the period of 2021-2030, with a vision to 2050, including the formulation of master plans and plans on land use at all levels to meet the land use needs of the sectors, fields and localities to serve the country's socio-economic development needs.

However, in the process of performance, there are still some shortcomings and problems such as the slow formulation and performance of land use master plans and plans; the review and adjustment of master plans and plans of sectors and fields with land use to ensure conformity with master plans and plans on land use have not been well conduted; the forecast of land use demand for sectors and fields is not close to reality.

In order to promptly meet the demand for land use for the socio-economic development, defense and security objectives in the new situation, ensure using land economically and effectively; overcome conflicts and overlaps in land use of sectors, fields and localities, the Prime Minister requested the People's Committees of the provinces and centrally-run cities to urgently focus on making the planning of land use for the period of 2021 - 2030 and making land use plans at all levels with the following main tasks:

- To promote the provincial planning, focus on the content of the plan for allocation and zoning of land according to the provisions of Clause 6, Article 1 of the Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law and send to the Ministry of Natural Resources and Environment for comments as prescribed in Clause 7, Article 1 of the Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law before integrating it into the provincial planning and sending it to the Ministry of Natural Resources and Environment for comments before December 1, 2021.

- To focus on directing the formulation of a 5-year provincial land use plan (2021-2025) according to regulations and send it to the Ministry of Natural Resources and Environment for appraisal and submission to the Prime Minister before December 1, 2021.

- To speed up the process of making, appraising and approving the district-level land use planning for the 2021-2030 period in accordance with the Law amending and supplementing a number of articles of 37 Laws related to planning, Article 1 of the Resolution No. 751/2019/UBTVQHI4 dated August 16, 2019 of the National Assembly Standing Committee on the explanation of a number of articles of the Law on Planning; Clauses 3, 4 and 9, Article 1 of the Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government; the deadline for completion is before September 1, 2021.

- To direct and conduct the formulation, appraisal and approval of annual district-level land use plans in accordance with law, serving as a basis for land recovery, land allocation, land lease, and change of land use purpose in the service of local socio-economic development requirements; clearly identify capital sources for the performance of works and projects, ensure using land economically and efficiently, ensure high feasibility, and prevent the situation of suspended projects affecting people's lives.

In case the district-level land use planning for the 2021-2030 period has not been approved but the land use norms in the land use planning up to 2020 have not been fully conducted, the provincial-level People's Committees shall direct the performance to comply with the provisions of Clause 4, Article 49 of the Land Law (amended in Clause 1, Article 6 of the Law amending and supplementing a number of articles of 37 Laws related to planning); at the same time directing the updating of the district's annual land use plan for implementation.

In addition, the Directive also sets out the implementation and requirements for ministries and branches as well as specific requirements for the Ministry of Natural Resources and Environment.
