To stipulate the criteria for defining high-tech enterprises

On 16/3/2021, the Prime Minister issued the Decision No. 10/2021 / QD-TTg stipulating the criteria for defining high-tech enterprises.

Accordingly, the Decision applies to enterprises manufacturing high-tech products and providing high-tech services in Vietnam and relevant agencies and organizations.

The criteria for identifying high-tech enterprises: Regulating at Points a and b, Clause 1, Article 18 of the Law on High Technologies No. 21/2008 / QH12, as amended and supplemented in Article 75 of the Law on Investment No. 67/2014 / QH13 and Clause 3 Article 76 of the Law on Investment No. 61/2020 / QH14, and also satisfying the following criteria:

- The revenue from high-tech products must reach at least 70% of the total annual net revenue of the enterprise.

- The rate of total expenditure on research and development activities of the enterprise (including depreciation of investment in infrastructure, fixed assets, annual recurrent expenditures on research and development activities; expenses on training and training support for research and development workers of enterprises, science and technology organizations and training institutions in Vietnam; copyright fees, transfer of ownership and rights to use subjects owning industrial services for research and development activities; fee for registration of recognition or protection of inventions or utility solutions in Vietnam) per value of total net revenue minus annual input value (including the value of raw materials and components for import production and domestic purchase) as follows:

+ The enterprises with a total capital of 6,000 billion VND and total number of employees from 3,000 people or more must gain at least 0.5%;

+ The enterprises other than those specified at Point a, Clause 2, Article 3, with a total capital of VND 100 billion and a total number of employees from 200 people or more must reach at least 1%;

+ The enterprises not falling into the cases specified at Points a and b, Clause 2, Article 3 must attain at least 2%.

- The percentage of employees directly conducting research and development with a college degree or higher qualification of the enterprise (the employees who have signed a labor contract with a term of one year or more or a contract with no definite term, in which workers with college degrees do not exceed 30%) of the total number of employees:

+ The enterprises with a total capital of 6,000 billion VND and total number of employees from 3,000 people or more must gain at least 1%;

+ The enterprises other than those specified at Point a, Clause 2, Article 3, with a total capital of VND 100 billion and a total number of employees from 200 people or more must reach at least 2.5%;

+ The enterprises not falling into the cases specified at Points a and b, Clause 3, Article 3 must attain at least 5%.

This Decision takes effect from April 30, 2021 and replaces the Prime Minister's Decision No. 19/2015 / QD-TTg dated June 15, 2015, defining the criteria for identifying high-tech enterprises.
