The Circular guiding the management and use of state budget funds to ensure the international treaties and international agreements

On 19/7/2022, the Ministry of Finance issued the Circular No. 43/2022/TT-BTC guiding the management and use of state budget funds to ensure the international treaties and international agreement.

Accordingly, this Circular guides the management and use of state budget funds to ensure the international treaties and international agreements in accordance with the provisions of the Decree No. 65/2021/ND-CP dated June 30, 2021 of the Government on the management and use of state budget funds to ensure the international treaties and international agreements; this Circular applies to agencies, organizations and individuals participating in the process of signing and implementing international treaties and international agreements under the provisions of the Law on International Treaties and the Law on International Agreements.

Regarding the expenditure levels for the ones for which there are documents stipulating the spending regimes and norms to comply with the current regulations, specifically:

- Expenses for organization of meetings, conferences, business fees in the country: To comply with the expenditure level as specified in the Circular No. 40/2017/TT-BTC dated April 28, 2017 of the Ministry of Finance on the regulations on business fees and conference expenses.

- Expenses for overseas business trips: To comply with the expenses as prescribed in the Circular No. 102/2012/TT-BTC dated June 21, 2012 of the Ministry of Finance, providing the regime of business fees for State cadres and officials to go on a short-term business trip abroad, funded by the State budget.

- Expenses for the review related to international treaties, international agreements as specified at Point c, Clause 1, Article 5; Point b, Clause 2, Article 5; Point d, Clause 3, Article 5; Point b, Clause 2, Article 6; Point c, Clause 3, Article 6, the Decree No. 65/2021/ND-CP: To comply with the spending levels as specified in the Joint Circular No. 122/2011/TTLT-BTC-BTP dated August 17, 2011 of the Ministry of Finance, the Ministry of Justice stipulating the estimation, management, use and settlement of funds to ensure the inspection, processing, review and systematization of legal documents.

- Expenses for translation; expenses for welcoming foreign delegations to work in Vietnam: To comply with the spending levels as specified in the Circular No. 71/2018/TT-BTC dated August 10, 2018 of the Ministry of Finance regulating the spending regime for welcoming foreign guests to come and work in Vietnam, spending on organizing international conferences and seminars in Vietnam and receiving domestic guests.

- Expenses for building and operating the database on Vietnam's international treaties located at the Ministry of Foreign Affairs as specified at Point e, Clause 6, Article 5 of the Decree No. 65/2021/ND-CP; the expenses for building and updating the database on international agreements as specified at Point c, Clause 6, Article 6 of the Decree No. 65/2021/ND-CP: To comply with the regulations on the investment management on information technology application, using state budget capital and amending and supplementing documents; the economic - technical norms in the field of information and communications and related guiding documents.

- Expenses for the propaganda and dissemination of international treaties and international agreements as specified at Point c, Clause 7, Article 5 and Point a, Clause 4, Article 6 of the Decree No. 65/2021/ND-CP: To comply with the expenditure levels as specified in the Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice stipulating the making, management, use and finalization of the State budget fund to ensure the law dissemination and education and the people's standard of access to law at the grassroots level.

In addition, the Circular provides specific guidance on the preparation and allocation of estimates, management and settlement of funds to ensure the international treaties and international agreements; implementation.

This Circular takes effect from September 5, 2022. The Circular No. 13/2018/TT-BTC dated February 6, 2018 of the Ministry of Finance guiding the management and use of state budget funds guaranteeing the work of international treaties and international agreements shall expire from the effective date of this Circular.
