The regulation prescribing on the field of investment and scale of PPP projects

On 29/3/2021, the Government has just issued the Decree No. 35/2021 / ND-CP detailing and guiding the implementation of the Law on Investment under the public-private partnership (PPP) mode; taking effect from the date of signing for promulgation.
This Decree details and guides the implementation of the Law on Public-Private Partnership Investment in the field of investment and scale of PPP projects; PPP Project Appraisal Council; contents in preparing PPP project; selection of investors to implement PPP projects; certification of completion and transfer of infrastructure works and systems; termination of the PPP project contract; handle of situations and violations in investment by PPP method.
The Decree specifies the scale of total investment for PPP projects in the following sectors, such as:
- From VND 1,500 billion or more for projects in the field of transport (including road; railway; inland waterways; maritime; aviation).
- From 1,500 billion VND or more for projects in the field of power grid, power plants; only projects in the field of renewable energy with a total investment of VND 500 billion or more.
- From VND 200 billion or more for irrigational projects; clean water supply, drainage and wastewater treatment; waste treatment.
- From VND 100 billion or more for projects in the health sector (including medical examination and treatment establishments; preventive medicine; testing).
- From VND 100 billion or more for projects in the field of education - training (including infrastructure, facilities, equipment for education - training and vocational education).
- From VND 200 billion or more for information technology infrastructure projects (including digital information infrastructure, information technology modernization in Party and state agencies; application and development of information technology, database, data center; shared national platforms, applications and services; network safety and security; the system for application and services for people and businesses; information and communications technology infrastructure (ICT) for smart cities).
This Decree takes effect from the date of its signing.
